A Temporary Restraining Order (TRO) was issued on December 31 preventing the U.S. Department of Labor rule on 鈥渃ompanionship services.鈥 The rule aims to exempt 鈥渃ompanionship services鈥 from overtime compensation under the Fair Labor Standards Act, which was due to be in effect as of January 1, 2015. The hearing is set for January 9. Should the rule eventually pass, it would significantly change a longstanding, 40 year-old federal overtime compensation exemption known as the 鈥渃ompanionship services鈥 exemption under the Fair Labor Standards Act.
